Terms of Use — Awaira

These Terms govern the Awaira desktop application, website, downloads, free trial, and paid licences. Awaira ("we", "us") provides the service. By downloading, purchasing, or using Awaira, you agree to these Terms. If you do not agree, do not use the service.
1. Eligibility
You must be legally able to enter into this agreement. If you are under the age of majority where you live, a parent or legal guardian must review and agree to these Terms for you. Awaira is not directed to children under 16.
2. What Awaira is
Awaira is a wellness and awareness application for supported macOS and Windows devices. It uses on-device computer vision to notice hand-to-face movements and provide reminders chosen by the user. Features, platform availability, and system requirements may change as the product develops.
3. Licence
Subject to these Terms and payment where applicable, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use Awaira on devices you own or control. A single-seat Pro licence may be active on one device at a time unless the checkout page or written offer expressly says otherwise.
You may not sell, sublicense, rent, distribute, copy except for a permitted backup, circumvent licence controls, interfere with the service, or reverse engineer Awaira except to the extent applicable law expressly permits and does not allow that right to be waived.
Awaira and its software, design, branding, and content remain owned by us or our licensors. No ownership rights are transferred to you.
4. Free trial
The Free edition may include a time-limited trial of paid features. The current duration is shown before download or inside the app. No payment method is required unless clearly stated otherwise. The trial is limited to one per device and uses a stable device identifier to prevent resets.
Trial availability and duration may change for future users, but we will not shorten an already started trial except to address abuse, security, or legal requirements.
5. Purchases, subscriptions, and renewal
Purchases are processed by Lemon Squeezy, our merchant of record. The checkout page shows the seller, currency, price, taxes, billing period, and material plan conditions before purchase.
- Monthly and yearly plans renew automatically at the price and interval disclosed at checkout until cancelled.
- A lifetime plan is a one-time payment for continued use of Awaira and the future Awaira updates included in the offer, for as long as a compatible supported version remains available. It does not promise perpetual online services or unrelated products sold separately.
- Lemon Squeezy sends the licence key and provides the customer portal used to manage billing or cancel a subscription.
- Cancellation stops future renewal. Unless law or the checkout terms provide otherwise, access continues through the already paid billing period.
- Refunds, cooling-off/withdrawal rights, and remedies follow the checkout terms and mandatory consumer law. Nothing in these Terms limits a non-waivable consumer right.
We may change future subscription prices on advance notice. A price change will apply no earlier than the next renewal permitted by the notice and applicable law; you may cancel before it applies.
6. Licence activation and availability
Awaira may periodically connect to our server and Lemon Squeezy to validate a trial or licence. The app includes a limited offline grace period but is not promised to work indefinitely without an internet connection. A licence may be deactivated from one device before activation on another. Contact hello@awaira.app if an activation result appears wrong.
7. Not medical advice
Awaira is a wellness and awareness tool. It is not a medical device and does not diagnose, treat, cure, or prevent trichotillomania, excoriation/skin-picking disorder, onychophagia, or any other physical or mental-health condition. It is not a substitute for a clinician, therapist, or emergency service.
Detection is imperfect and may miss movements or flag ordinary movements. Do not rely on Awaira to prevent injury or as the sole response to a health concern. Seek advice from a qualified professional when appropriate. If you may be in immediate danger, contact local emergency services.
8. Your content and feedback
You retain ownership of messages, feedback, and attachments you submit. You give us only the rights needed to receive, store, review, and use them to respond, provide support, secure the service, and improve Awaira in accordance with our Privacy Policy.
We will publish feedback as a testimonial only when you separately opt in. That permission is non-exclusive, worldwide, and royalty-free for Awaira-controlled marketing, but ends when you withdraw consent. We will then remove the testimonial within a reasonable period, subject to cached or archived copies and legal obligations.
You must not submit content that is unlawful, malicious, infringes another person's rights, or contains information you do not have permission to share.
9. Privacy
Our Learn Privacy Policy explains on-device processing and the limited personal data processed by our servers and providers. It forms part of these Terms for transparency but is not intended to reduce any statutory privacy right.
10. Updates and changes to the service
We may provide fixes, security updates, and feature changes. Some updates may be required for safe operation or continued server compatibility. We may modify or discontinue a feature for security, legal, technical, or business reasons. Where reasonably possible, we will give advance notice if a change materially reduces paid functionality.
11. Suspension and termination
You may stop using Awaira at any time. We may suspend or terminate access where reasonably necessary because of material breach, fraud, licence abuse, security risk, non-payment, or legal requirement. Where appropriate, we will give notice and an opportunity to correct the issue.
On termination, the licence granted by these Terms ends, but provisions that by their nature should survive—including ownership, disclaimers, liability, and dispute provisions—continue. Termination does not remove mandatory refund or consumer rights.
12. Disclaimers
To the maximum extent allowed by law, Awaira is provided "as is" and "as available." We do not promise uninterrupted availability or perfect detection, compatibility, or results. Nothing in these Terms excludes warranties, guarantees, or remedies that applicable consumer law does not allow us to exclude.
13. Limitation of liability
Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence where applicable.
Subject to that paragraph, we are not liable for indirect or consequential loss, loss of profit, business, opportunity, goodwill, or data that was not reasonably foreseeable when you agreed to these Terms. For paid use, our aggregate liability arising from Awaira will not exceed the greater of the amount you paid for Awaira in the 12 months before the event giving rise to the claim or USD 100, except where applicable law requires a different remedy. This limitation does not reduce mandatory consumer rights.
14. Governing law and disputes
These Terms are governed by the laws of the Republic of Armenia, without regard to conflict-of-laws rules. If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of your usual country of residence, and you may bring a claim in any court available under mandatory consumer law.
Please contact hello@awaira.app first so we can try to resolve a concern informally. Nothing here prevents either party from seeking urgent court relief or using a regulator, consumer body, or dispute procedure available under applicable law.
15. Changes to these Terms
We may update these Terms for legal, security, or product reasons. We will post the revised Terms, update the effective date, and give reasonable additional notice before a material change applies to an existing paid user. Changes will not retroactively remove accrued rights. If you do not agree to a material change, you may stop using Awaira and exercise any cancellation or remedy available under applicable law.
16. General
If a provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions continue. A delay in enforcing a right is not a waiver. You may not transfer this agreement without our consent; we may transfer it as part of a genuine reorganisation or sale, subject to applicable law. These Terms, the checkout terms, and any written plan-specific terms form the agreement concerning your use of Awaira.
